Therefore, he is not a covered entity and has no obligation to protect any protected health information (PHI). I doubt there was a patient-physician relationship ever established. The hook in hipaa is the bill-paying bit. The provision of medical services is not the primary function of a fire department. Any FD vehicle in er transit should be monitored by the er/etc of the receiving, medical facility. Our local FD presumes to have medical training and competence to evaluate the region's largest hospital by virtue of attendance at Pike's Peak Fire Fighting school, and the department has no medical director. Their board of oversight is politically appointed, not even elected. Please take a look. Do more than that; keep this issue alive, even if you don't get Dr.Phil's press ;-) And thanks for being there!!
